You should also review any terms and conditions specified by individual Sellers on [www.farandfound.co.uk] before you buy anything through our website.

 

We may update these Terms, the Privacy Policy (and any other documents referred to) from time to time and will upload such changes to this site.

 

These Terms set out your legal rights and responsibilities; our legal rights and responsibilities; and certain key information required by law. If you do not agree to these Terms, please do not use this website and / or our Service.

In these Terms:

you’ or ‘your’ means the person using our site to purchase goods from one or more of sellers on this site; and

seller” or ‘sellers’ means the Vendor. Vendors sell a range of quality gifts via our marketplace

Our Sellers are our partners, please treat them with courtesy and respect. Sellers on our site are all fabulous small business owners and each has been vetted for quality purposes by Far&Found.

1. Who are we?

2. Service

Our services are a platform that links together conscious customers and amazing vendors. We curate an incredible list of the best local gift suppliers across the UK and provide the ability for customers to search by their giftees postcode to find and send local gifts. We provide the platform for vendors to create their own pages on our site and appear in these customer searches. Any gift sales take place between the customer and the vendor on the Far&Found platform.

Please ensure you review these Terms, the email order confirmation and the details listed on the Seller’s product page which relate to your order. In the event of an inconsistency or conflict, these terms shall prevail to the extent of the conflict. 

Direct contact with vendors in advance of a sale should not be made, nor should Customers attempt to take vendor business off of the Site. Should this take place, it may lead to Sellers being removed from the Site. Far&Found is an independently run marketplace and we have worked hard to give our vendors fair competitive rates to allow them to flourish.

3. Introduction

If you buy  through our site you agree to be legally bound by this contract.

These terms and conditions apply only if you are buying goods through our site as a consumer (i.e. for purposes outside of your business, craft or profession). If you are a Seller in the course of business, our Seller Terms and Conditions apply

This contract is only available in English. No other languages will apply to this contract.

6. Disclaimer of Warranties and limitation of liability

We do not review or control, and are not responsible in any way for, listings provided by Sellers and at no time do we possess any items offered for sale by Sellers through the Site.

Where you follow links to third party websites from this Site, we have no control of such third party sites and you do this entirely at your own risk. We accept no responsibility for third party websites or for any loss or damage that may arise from your use of them.

We reserve the right to withdraw or amend the services, and / or restrict access to any / all of the Services we provide without notice and we accept no liability if any of the Services are unavailable for any period.

It is your responsibility to ensure that all information (including your name and address) you upload to the Site, is correct and accurate. Ensure that you check all information before making a purchase.

Any and all express or implied warranties are disclaimed by us to the fullest extent permitted by law. This does not affect your statutory rights against the Seller. Nothing in these Terms shall limit or exclude our liability for fraudulent misrepresentation, for death or personal injury resulting from our negligence or the negligence of our employees or for any other liability that cannot be limited or excluded by law.

7. Using our Services

Below, we set out how a legally binding contract between you and a Seller is made.

You place an order on the site by paying for goods/services with any of our sellers, which comprises an offer by you to purchase the goods specified. Please read and check your order carefully before submitting it.

When you decide to purchase goods from a Seller, the contract you enter into is between you and that Seller. That contract comprises these Terms, the email order confirmation and the details given by the seller on the product page. You agree to be bound by these provisions.

The contract between you and a Seller relates only to those goods notified in the email acknowledgement of order

8. Refusal of Transaction

  1. the Seller is unable to fulfill the order;

  2. your payment has not been authorised;

  3. you are prohibited from buying the Goods (for example, because you have not confirmed you are 18 years old or over); or

9. Payment

We accept the following credit cards and debit cards: Mastercard, Visa, American Express and Apple Pay. We do not accept cash or cheques.

When buying with a Seller on Farandfound.co.uk you authorize Far&Found to send instructions to the financial institution that issued your card to take a payment from your card account in accordance with the terms of your agreement with the Seller.

Your credit card or debit card will only be charged when you complete the order

All payments by credit card or debit card need to be authorised by the relevant card issuer. We may also need to use extra security steps via:

All prices are in pounds sterling (£)(GBP) for UK Sellers and include VAT at the applicable rate

 

11. Third party rights

 

No provision of these Customer Terms shall be enforceable by any third party under the Contracts (Rights of Third Parties) Act 1999 or otherwise. 

 

12. Feedback and Complaints

 

We will try to resolve any disputes with you quickly and efficiently. If you are unhappy, please contact us as soon as possible using the contact details set out at the top of this page. Comments and feedback about the Site are welcome. 

 

Complaints or issues with a specific Seller, goods or delivery must be directed to the Seller concerned through the contact details provided on the order confirmation email that you receive for resolution directly with them.

 

The laws of England and Wales will apply to contracts for the purchase of goods through our Site and any dispute arising out of such contracts will be subject to the exclusive jurisdiction of the courts of England and Wales.

 

13. Intellectual property rights

We hold all right, title and interest in and to the Service, including all intellectual property and all other proprietary rights relating to the Site. You must not extract or otherwise use any of the content on the Site and/or Service for commercial purposes without obtaining a licence to do so from us or our licensors. We respect the intellectual property rights of others and we ask our Customers and Sellers to do the same. If you become aware of any intellectual property infringement on the Site, please contact us to report this. 

14. Delivery arrangements

The Seller will provide details of postage and packing, including delivery costs. dAny delivery times quoted are in working days and any delays are outside of the control of Far&Found. 

15. Returns

If you wish to discuss or organise a return, replacement or refund of an item purchased through the Site, please contact the vendor directly. Gifts can only be returned if faulty for a full refund. The vendor can issue a credit note for all other circumstances of return that is redeemable in their store only. Unfortunately some items are non-cancelable and non-refundable such as baked goods. 

16. Viruses, malicious material and other offences

You must not introduce viruses or other malicious or harmful material to our Site and we do not permit automated software, bots, and / or other scraping tools to be used on our site to: login; skim vendor lists; skim customer lists; and / or send messages to any vendors or users.

Any of the actions listed in this clause may result in removal from the site and / or legal action, including pursuing prosecution of offences committed under the Computer Misuse Act 1990. 

17. Waiver

No waiver by us of any of these Terms of Service shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

18. Severability

If any of these Terms are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

19. Entire agreement

These Terms of Service and any documents expressly referred to in them constitute the entire agreement between us.

Sellers

  • Business details (including name, URL, social media handles, registered address, VAT details and more)

  • Information on the products you offer currently and have offered previously

  • Any billing and shipping addresses you have entered

  • Payment method used by you

  • Payout method used by you

  • Orders that have been placed with you

  • Your IP Address

  • Responses you have made to Customer product reviews

  • Information you have entered in a Contact Form

  • Correspondence between you and / or Customer and / or a Recipient and / or Far&Found

How we get the personal information and why we have it

Most of the personal information we process is provided to us directly by you for one of the following reasons:

  • You wish to purchase goods from a Seller on our site www.farandfound.co.uk

  • You wish to write a review about the goods you as a Customer or Recipient have received or your purchase experience

  • You contact Far&Found 

  • You contact a Seller through Far&Found

  • You set up an account for the purpose of gift reminders 

We also receive personal information indirectly, from the following sources in the following scenarios:

  • Customers may enter information relating to the final Recipient of orders. Where this is the case, the following data may be collected about the Recipient, as entered by the Customer:

    • Name

    • Email address

    • Phone number

    • Information on the products that Customer(s) have sent you

    • Any shipping addresses associated with you

    • Correspondence between you and / or a Seller and / or Far&Found

We use the information that you have given us in order to process payment, ensure your gifts arrive in the right place, remind you of upcoming gifting dates, communicate with you and to better understand which products and vendors our communities use and when. 

We may share some of this information with Google, Facebook & mailchimp in order to contact you if you have agreed to marketing permissions.

Under the UK General Data Protection Regulation (GDPR) and under the General Data Protection Regulation (EEA GDPR), the lawful bases we rely on for processing this information are: We have a legitimate interest.
